OFFICIAL SWEEPSTAKES RULES

CONTEST DESCRIPTION:

The “Home Jamz Summer Jam” Sweepstakes will begin on Monday, June 24, 2013 and end on Wednesday, July 10, 2013. One (1) winner(s) will be awarded one (1) pair of tickets to the “Z1079 Summer Jam presented by McDonald’s” and an opportunity to perform onstage with Colby Colb and perform one (1) song, on Sunday, July 14, 2013 at House of Blues Cleveland, Euclid Ave, Cleveland Ohio 44114.

HOW TO ENTER:

Listeners of WENZ-FM who are legal residents of the U.S., residing within the Cleveland, OH metropolitan area and are 18 years of age and older will be able to take part in this Sweepstakes. To participate in the Sweepstakes, listeners must do the following:

1. Contestants must log on to WENZ-FM’s website (www.zhiphopcleveland.com), follow the link to the Sweepstakes page and submit an mp3 audio file of their original music to be registered for a chance to win. No covers or sampling of other artists’ material or music is permitted, and may lead to disqualification.

2. Upon entering the Sweepstakes website, participants are to follow the on-screen instructions, including entering their name, date of birth, address, phone number, email address, and any optional or additional contact information, as requested.

3. Only one (1) entry per person. All Internet entries must be received by 11:59 PM EST on July 9, 2012 or they will be void.

4. Submitted entries must be “family friendly”, appropriate for all audiences, and must meet the below-listed Entry Requirements.

5. Entries will be posted online for public voting. Listeners of WENZ-FM will be instructed to vote on the posted entries to select the winners. The voting period will take place from 12:01 am on July 1, 2013 through 11:59pm on July 10, 2013.

6. One (1) vote per person. Any attempt by an entrant and/or his/her family/friends to vote more than the number of times authorized by using multiple names or email address, IP Adresses and/or any other fraudulent mechanism, as determined by the Station in its sole discretion, shall give the station the right to disqualify the entrant in its reasonable discretion.

7. In the event of a dispute regarding the identity of a participant’s entry, the entry will be deemed to have been made by the authorized holder of the email account at the time the entry was made.

8. McDonald’s USA, LLC is not responsible for administering this Promotion or selecting the winners.

9. By uploading a submission and entering this sweepstakes, each participant represents and warrants to be bound by the Official Sweepstakes rules, that they are authorized to and have the rights to submit the content in the entry, and that all of the below-listed requirements have been met.

• Entry Requirements:

• Entries may not be patently offensive, illegal, pornographic or obscene, or similarly inappropriate in the Station’s sole discretion

• Entries must not contain any profanity, obscene language, lewd or sexual content or references

• Submissions may not infringe upon any rights of any third party including without limitation, copyright, trademark and right of publicity or privacy

• Entries must be produced and solely owned by the contestant submitting the entry

• Entries must be unpublished and not have been submitted in other competitions

• Submissions must not contain: unnecessary violence, derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliate other people (publicly or otherwise), or otherwise assault or threaten others

• If additional individuals are featured in the entry, each entrant warrants and represents that the entrant has obtained permission from each person who appears in the submission

• Entries must be unpublished and not have been submitted in other competitions

• Entries must not contain commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements

• If any individuals, in addition to contestant are featured in the entry, each entrant warrants and represents that the entrant has obtained permission from each person who appears in the submission

ELIGIBILITY RESTRICTIONS:

1. The Sweepstakes is open to listeners of WENZ-FM who are 18 years of age and older and are legal residents of the U.S. residing within the Cleveland, OH metropolitan area.

2. Employees of WENZ-FM, Blue Chip Broadcasting, Ltd., McDonald’s USA, LLC (“McDonald’s”), their respective subsidiaries, affiliates, general sponsors, advertisers, divisions, franchisees, distributors, suppliers competitors, promotional partners, other radio stations in the Cincinnati, Ohio metropolitan area, and members of the immediate families or those living in the same households of any of the above (whether related or not) are NOT eligible to participate or win in this Sweepstakes. For purposes of this Sweepstakes, immediate family members mean spouses, parents, grandparents, children, and siblings and their respective spouses.

3. Once an individual wins a prize in this sweepstakes, they are not eligible to win another prize in this sweepstakes except as specified within these rules.

4. Persons who have won a prize in another sweepstakes or promotion of any kind from WENZ-FM within the thirty (30) day period immediately preceding the start date of this Sweepstakes are not eligible to participate. Only one (1) person per family or household (whether related or not) may win in any promotion from WENZ-FM during any thirty (30) day period.

PRIZES:

1. The prize for the winner will include the following:

One (1) pair of tickets to the “Z1079 Summer Jam presented by McDonald’s” (ARV: $59), and an opportunity to perform one (1) song on stage, on Sunday, July 14, 2013 at House of Blues, Euclid Ave, Cleveland Ohio 44114. Transportation to and from the event venue, souvenirs and incidentals are the responsibility of the winner and his or her guest.

2. Prizes are not mailed. All prizes provided by WENZ-FM or provided by the participating sponsor must be claimed at the station’s offices by 5pm July 12, 2013.

3. No substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value, except as determined by station management and/or the sponsor in its sole discretion.

4. All sweepstakes winners must sign and date official station release and waiver forms as requested. Failure to do so will result in winner forfeiting the prize.

5. If for any reason a contest winner decides not to accept an awarded prize, the winner will be required to sign a release form acknowledging forfeiture of the prize. It will be at the discretion of the sweepstakes sponsor and / or sweepstakes administrator if another contestant is to be selected as the winner if time permits.

6. If sweepstakes winner does not claim their prize by 5pm July 12, 2013, the prize will be forfeited.

7. Winners must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim their prize.

EXECUTION:

1. During the Sweepstakes Period, eligible listeners will be encouraged to participate in the Sweepstakes by logging onto WENZ-FM’s website (www.zhiphopcleveland.com) and following the link to the Sweepstakes page and submitting their entry to be registered for a chance to win. After completing the registration process, qualified entrants will be eligible for judging and a chance to win the grand prize.

2. The one (1) contestant with the most votes from among all eligible entries received via www.zhiphopcleveland.com will be declared the winner.

3. Winner will be notified by phone.

4. Winner will be instructed to claim their prize at WENZ-FM offices located at 6555 Carnegie Ave Suite 100 Cleveland OH 44103.

5. All decisions made by WENZ-FM and Blue Chip Broadcasting, Ltd., management regarding any aspect of this Sweepstakes are final.

GENERAL CONDITIONS:

1. Winner is responsible for all applicable taxes associated with the receipt of the prize .

2. Any person winning over $600.00 in prizes will receive an IRS form 1099 at the end of the calendar year for tax purposes and a copy of such form will be filed with the IRS as required by law.

3. No purchase necessary. Sweepstakes is void where prohibited. Sweepstakes is subject to all applicable federal, state and local laws and regulations.

4. Odds of winning depend upon the number of eligible contestants participating during the Sweepstakes Period.

5. By participating in the Sweepstakes, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this sweepstakes, in any media now known or hereafter devised for advertising or promotional purposes without additional compensation, and must sign a publicity release prior to acceptance of the prize. By entering this Sweepstakes, each participant agrees to comply with the Official Rules and the decisions of the sweepstakes sponsor which shall be final and binding in all aspects relating to the sweepstakes.

6. All Sweepstakes winners will be required to sign a liability release prior to acceptance of any prize. Pursuant to the liability release, the winner or winners will agree to hold WENZ-FM, Blue Chip Broadcasting, Ltd., McDonald’s, any other sweepstakes parties and each of their respective affiliates, subsidiaries, agencies, officers, shareholders, directors, employees, agents and representatives of each of the foregoing, harmless against any and all claims or liability, directly or indirectly related to or arising from or in connection with Sweepstakes participation or the acceptance, possession or use / misuse of awarded prize or any portion thereof, or participation in prize-related activities, including but not limited to any related travel.

7. Winner must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim their prize.

8. The station retains the right to disqualify any contestant if all Sweepstakes rules are not followed. Sweepstakes void if prohibited by law.

9. So long as no participant is materially adversely affected, the station reserves the right to make changes in the Sweepstakes rules, which will become effective upon being announced on the air and / or posted online.

10. WENZ-FM, Blue Chip Broadcasting, Ltd., McDonald’s, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for the inability of any contestant to complete or continue a telephone call, facsimile transmission, text message or internet registration due to equipment malfunction, busy lines, inadvertent disconnections, communication failures or human error that may occur in the transmission, receipt or processing of entries. In addition, WENZ-FM Blue Chip Broadcasting, Ltd, McDonald’s, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for lost, misdirected, mutilated, illegible or incomplete Sweepstakes entries. Once submitted, entries become the property of the station and will not be returned.

11. By accepting the prize, the winner acknowledges that WENZ-FM and Blue Chip Broadcasting, Ltd., have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.

12. WENZ-FM, Blue Chip Broadcasting, Ltd., its subsidiaries, its affiliates, participating sponsors and promotional partners will not assume any responsibility for any changes in the execution of the Sweepstakes, including; cancellation of the Sweepstakes as a result of the occurrence of events not within the control of WENZ-FM, Blue Chip Broadcasting, Ltd., its subsidiaries, affiliates, participating sponsors, promotional partners and other radio stations, such as Acts of God, strikes, terrorists acts or criminal acts of third parties. In the event, such an act should occur, the station may in its sole discretion offer the winner comparable prize(s) currently being offered by the station in lieu of the prize originally awarded.

13. Copies of Sweepstakes are available upon request during regular business hours, Monday – Friday 9:00 a.m. to 5:00 p.m., in the offices of the WENZ-FM located at 6555 Carnegie Ave Suite 100 Cleveland OH 44103. Copies of Sweepstakes may also be made available during on-site / in-person remote events.
